Building Rules & Regulations
Approval by Architectural Committee All modifications to the exterior of any home or building site require prior approval by the Hidden Hills Architectural Committee. Exterior modifications including, but not limited to, painting, changing windows, doors, roofs, remodeling, repairs, major landscaping, tree planting or removal, concrete work or any other type of exterior work. Please refer to the Architectural Standards for rules governing such work. Most work that needs a City Building Permit also needs Architectural Approval. Commencing construction without prior Architectural Committee approval or constructing improvements different from what is shown on the approved plans is strictly prohibited.
Working Without Approval Vendors attempting to do exterior work that has not been approved by the Architectural Committee will be denied access until the Owner files the appropriate paperwork and receives approval.
Construction Schedule
- Approved construction is limited to Monday through Friday, 7:00 a.m. to 8:00 p.m. and Saturday, 8:00 a.m. to 8:00 p.m.
- No construction is permitted on Sundays or holidays.
- For purposes of gate entry, construction includes, without limitation, gardening, pool service, and other interior and exterior workers.
- Admitting construction workers on a holiday constitutes a violation of this provision.
Holidays
The following Holidays are observed per the Municipal Code of the City of Hidden Hills(Code Title 1 - Chapter 8):
- New Year's Day
- Martin Luther King Day
- President's Day
- Memorial Day
- Independence Day
- Labor Day
- Veteran's Day
- Thanksgiving Day & the Friday After
- Christmas Day
Emergency Repairs Emergency repairs are permitted on Sundays and holidays, and before or after the appointed construction schedule. Residents must notify the gate guard of the vendor they are expecting and that it is an emergency repair.
Construction Debris Trades people and residents are prohibited from dumping, sweeping, blowing or washing construction debris, oils, repair residue, concrete, or any toxic or poisonous material into the street, swales, parkways, bridle trails or any other Association-owned property or easements. A plastic tarp or similar material cover must be placed on the street or parkway prior to the placement of dirt, sod, sand, cement or other materials. Whenever possible, the residents driveway rather than the street should be used for mixing materials.
Oversized Trash Bins Residents who require oversize trash bins for construction or major clean-ups are required to either keep the bin on their property or obtain an Encroachment Permit to place it in the parkway. Encroachment permits may be obtained from the Association offices.
Contractor Access Residents with construction projects should provide a list of their contractors and subcontractors to the Gate Operations Officer at each gate, along with the dates of duration of the construction project.
- Persons identifying themselves as employees of the contractors or subcontractors should be admitted after being logged in (name, contractor, license number).
- Advise the workers they will be delayed each time unless they are listed on the resident's admit list.
- Construction workers, contractors, gardeners and other maintenance workers: Gardeners and maintenance crews (including pool maintenance) should be admitted in accordance with Gate Operations Manual, Section (c).
Consequences of Violations The Consequences of Violations rules below are from the HHCA ByLaws Document, Article 13, ENFORCEMENT & DISPUTES. In order to preserve the property values and maintain the character of this community, all Residents must comply with the provisions of the Governing Documents, including but not limited to the Rules & Regulations and Architectural Standards. For those who fail to comply, membership rights and privileges may be suspended, monetary fines may be imposed, and the Board may impose any other sanctions that would be legal under the laws of the State of California. In the event of a violation of the Architectural Standards, in addition to the foregoing,
- Any existing approvals given by the Architectural Committee may, at the Board's discretion, be deemed rescinded, and
- The Board may require the property to be returned to its prior compliant status, and
- The Board may require the violation to be corrected to the reasonable satisfaction of the Architectural Committee before any further work is permitted and any further approvals are given.
Examples of the privileges that may be suspended include, but are not limited to, the right to vote, the right to use any of the Community Facilities, the right to apply for or receive Architectural Committee approval for any improvement made on a Building Site (except for such approval which is needed to correct an architectural violation), the right to priority access through the resident's entry lane at the gate houses, the right of resident's guests to expedited access through the guest lane using a guest bar code decal, and the right to receive all non-essential services from the Association.
Except as provided in Section 2.4(e) of the Bylaws, any sanctions imposed under this section shall apply for all Building Sites owned by the Member even if the violation exists only as to one Building Site.
No such suspension or fine shall be imposed until the Board has held a hearing, upon a minimum of thirteen (13) days' written notice to the Member, and the Member has had an opportunity to be heard at an executive session meeting of the Board.
Notwithstanding the above, the suspension of rights shall be automatic in the event any assessments are more than 30 days delinquent.
In the event any rights are suspended under this section, the suspension shall also apply to the Member's entire family and to his tenants, invitees and guests. Should any Member fail to pay a fine, correct a violation, or otherwise fail to comply with the disciplinary action of the Board within thirty (30) days of having his or her membership rights and privileges suspended, the Association may pursue the enforcement pursuant to sections 14.6 and/or 14.7 of the Bylaws.
